房地产法律与政策(54学时)课程简介

房地产法是社会主义市场经济法律体系的重要组成部分,对于促进房地产市场的健康发展,维护房地产市场秩序,保护房地产法律关系当事人的合法权益具有重要作用。房地产法(54学时)系统阐述了涉及房地产物权、房地产开发、房地产经营管理、房地产交易、物业管理和房地产税收等方面的房地产法律制度和政策,主要内容包括房地产所有权法律制度、城市房地产权属登记法律制度、建设用地制度与政策、房地产开发经营管理法律制度、房地产交易管理制度与政策、物业管理制度与政策、房地产税收制度与政策和住房公积金管理制度与政策。其中,建设用地和土地使用权的取得方式、房地产权关系、房地产登记制度等可以视为房地产法的基础;房地产开发制度和房地产交易制度则构成了本门课程的主体结构。前者主要涵盖了房地产开发中的行政监管、建设工程施工合同、工程建筑质量管理、国有土地上房屋征收与补偿等;后者主要包括商品房买卖合同、房地产转让、房地产中介服务、房屋租赁、房地产抵押等。

Real Estate Law (54 class hours)

Real Estate Law, an important part of the legal system of socialist market economy, plays an important role in promoting the healthy development of the real estate market, maintaining the order of real estate market, and protecting legitimate rights and interests of the relevant litigants. Real estate law (54 hours) describes the legal system relevant to the real estate property, real estate development, real estate management, real estate transactions, property management and real estate taxes and other aspects of the real estate legal system and policies. The course mainly includes the systems and policies of real estate ownership, real estate registration, construction land, real estate development and management, real estate transaction management, the property management, the real estate taxes and housing provident fund. Among them, the construction land acquisition, property right relationship, real estate registration system consist of the foundation of real estate law. The real estate development system includes administrative regulation, real estate development in the construction contract management, construction project quality, urban housing collection and compensation etc. The real estate transaction system focuses on commodity housing sales, the transfer of real estate, real estate intermediary services, housing rental, real estate mortgage. The real estate development system and real estate transaction system constitutes the main body of the course.
